L’interdiction pour un dirigeant de racheter sa propre entreprise \u00e0 la barre du tribunal est un principe fort du droit fran\u00e7ais, visant \u00e0 \u00e9viter l’effacement opportuniste des dettes. Pourtant, des exceptions existent. Dans cet article, Ma\u00eetre Patricia Guyomarc\u2019h analyse l\u2019assouplissement proc\u00e9dural introduit lors de la crise sanitaire et rappelle les fondements de l’article L.642-3 du Code de commerce.<\/p>\n

L’analyse d\u00e9montre que l’ordonnance de 2020 n’a pas cr\u00e9\u00e9 un droit nouveau, mais a simplifi\u00e9 un \u00ab\u00a0raccourci proc\u00e9dural\u00a0\u00bb pour favoriser la survie des activit\u00e9s. Ma\u00eetre Guyomarc\u2019h souligne qu’en dehors de ces mesures exceptionnelles, la facult\u00e9 de reprise par le d\u00e9biteur reste possible, mais demeure strictement encadr\u00e9e par l’examen pr\u00e9alable du Minist\u00e8re public.<\/p>\n

Cette note d\u2019expertise illustre la capacit\u00e9 du cabinet \u00e0 naviguer dans une r\u00e9glementation complexe et mouvante pour pr\u00e9server l’outil de travail.
